THE CUSTOMER SHALL ENSURE ITS CUSTOMERS FULLY COMPLY with the Do Not Call Provisions of the FTC's Telemarketing Sales Rule, including but not limited demonstration that (1) it has written procedures to comply with the do not call requirements, (2) it trains its personnel in those procedures, (3) it monitors and enforces compliance with these procedures, (4) it maintains a company-specific list of telephone numbers that it may not call, (5) it accesses the national registry no more than 31 days before calling any consumer, and maintains records documenting this process, (6) any call made in violation of the do not call rules was the result of an error.

THE CUSTOMER AGREES TO READ THIS DOCUMENT COMPLETELY. THIS SERVICE COMES WITH NO WARRANTY. THIS IS AN EXPERIMENTAL SERVICE PUT FORTH BY A NEW COMPANY WITHOUT EXPERIENCE. DO NOT USE THIS SERVICE FOR CALLS THAT ARE DEEMED EVEN MARGINALLY IMPORTANT. DO NOT USE THIS SERVICE WITHOUT HAVING A LIVE AND FULLY FUNCTIONAL BACKUP SERVICE WHICH CAN PERFORM ALL OF THE SAME TASKS. DO NOT USE THIS SERVICE WITHOUT HAVING STANDARD TELEPHONE SYSTEM (NON-VOIP) BACKUP.

The term customer in this document applies to non paying users, too.

THE CUSTOMER SHALL NOT LOSE LOGIN AND PASSWORD INFORMATION AND UNDERSTANDS THERE MAY BE A LONG, UNSPECIFIED DELAY TO HAVE THIS INFORMATION RETRIEVED. UNRETRIEVED PASSWORDS DO NOT VOID ANY PENALTIES THAT MAY OCCUR, SUCH AS REFUND FEES AND DORMANT ACCOUNT CLAUSES. VOIPJET MAY ARBITRARILY CHOSE TO IGNORE A PASSWORD REQUEST IF IT IS SUSPECTED TO BE FRAUDULENT.

THE CUSTOMER WILL ENSURE THAT THEY ARE LEGAL ENTITIES THAT ARE ALLOWED TO PURCHASE WHOLESALE TERMINATION IN THEIR COUNTRY WITHOUT TAXATION OF THE COST OF SERVICE. THE CUSTOMER SPECIFICALLY AGREES TO NOT USE THE SERVICE TO COMPLETE CALLS THAT BOTH BEGIN AND END WITHIN THE COUNTRY OF CANADA.

THIS IS NOT A SERVICE FOR END USERS.

THIS SERVICE DOES NOT PROVIDE EMERGENCY 911 SERVICES. IT IS NOT DESIGNED TO DO SO.

The customer agrees to use this service for lawful purposes, only. The customer agrees to verify use of this service, and all corresponding call usage, complies with all application laws in Canada and the USA. The customer agrees to set the CallerID/ANI information in their Asterisk configuration to that which corresponds to them, and which will not cause confusion with another person or party, in the case that the CallerID/ANI information is passed by VoipJet.

IT IS SPECIFICALLY FORBIDDEN TO USE THIS SERVICE FOR EMERGENCY, MEDICAL, FINANCIAL, GOVERNMENTAL CALLS OR ANY OTHER IMPORTANT CALLS.

The customer agrees to have their email address on the VoipJet mailing list at all times during usage of service and is responsibility for checking the web version of the mailing list weekly to ensure no emails have been missed by them. The customer agrees that removal from the mailing list will only occur by them unsubscribing online and not by contacting VoipJet by email.

This agreement begins effect immediately upon usage of VoipJet's products and services, whether purchased or obtained freely, and consititues a legally binding agreement. If, at any time, the customer does not agree to all of the following terms then the party should immediately notify VoipJet and discontinue all usage of products and services.

VoipJet specifically makes no warranties, expressed or implied including but not limited to merchantability or fitness for a particular purpose, regarding its products or services.

The customer understands the experimental nature of VoipJet's services, the inherent instability of the internet, and that VoipJet is a newly founded company without previous telecom or internet certification or experience. VoipJet shall not be held liable for failure of service, either expected or implied, at any time. VoipJet, its ownership and managment, all shall not be held liable for direct or indirect loss of revenue or profits arising due to failure of VoipJet service at any time. The customer acknowledges that the service may not be working for some, most or all of the time.

The customer may request a full refund of unused credit from VoipJet within thirty (30) days of initial deposit, less any unavoidable transfer charges. Refunds requested after thirty (30) days are subject to administrative and transfer charges. The minimum administrative charge is one hundred dollars (100) USD. Dormant accounts, which have no activity, will be closed after six (6) months and any remaining refunds forfeit.

All payments to VoipJet via PayPal will first be used to pay any possible negative balance a customer has with VoipJet. It absolutely can't be used for new calls until the negative balance is paid off. The doesn't necessarily apply to wire transfers, and arrangements can be made.

VOIPJET RESERVES THE RIGHT TO PERMANENTLY DISCONTINUE SERVICE AT ANYTIME AND WITHOUT NOTICE AND WILL ISSUE FULL REFUNDS ON UNUSED BALANCES AT THIS TIME.

The customer understands that all materials on the VoipJet website are intellectual property of VoipJet and may not be copied. "VoipJet" and "Rapid-IP transit" are trademarks of VoipJet.

NON-DISCLOSURE: ALL CUSTOMERS USING VOIPJET'S SERVICE ARE SPECIFICALLY PROHIBITED FROM DISCLOSING TO OTHERS THAT THEY USE VOIPJET'S SERVICE, THIS INCLUDES BUT IS NOT LIMITED TO, END USERS. CUSTOMERS MAY NOT DISCLOSE USE OF OR PAYMENTS TO VOIPJET ON PERSONAL, CORPORATE, LEGAL, ACCOUNTING AND OTHER DOCUMENTS AND COMMUNICATIONS UNLESS SPECIFICALLY REQUIRED TO DO SO BY LAW.

RATES QUOTED TO CUSTOMERS AND RATES PAID BY CUSTOMERS ARE STRICTLY CONFIDENTIAL AND MAY NOT BE SHARED WITH ANY OTHER PERSON OR LEGAL ENTITY.

This agreement makes it clear that the customer is not provided with any claim or remedy, legal or otherwise, with regards to the use of VoipJet service and the interaction with VoipJet Inc. The Customer agrees not to undertake any action, direct or indirect, that would harm VoipJet or its ownership and management in any way, including financially.

THIS AGREEMENT MAY CHANGE AND THE ONLY EXPECTED NOTICE IS UPDATE OF THIS DOCUMENT, WITHOUT ANNOUNCEMENT, ON THE VOIPJET WEBSITE.

RATES ARE SUBJECT TO CHANGE AT ANY TIME WITH NEW RATES POSTED ON THE VOIPJET WEBSITE. ADVANCE WARNING MAY NOT BE ISSUED.

All quotes are valid for the day they are issued, only.

The customer agrees to purchase VoipJet termination in small amounts, and not to base an financial or business plan on VoipJet service, forcasts or communications. Again, the customer will have backup arangements in place that fully covers the breadth of VoipJet's service prior to its use. THE CUSTOMER AGREES NOT TO USE THIS SERVICE UNLESS THEY HAVE SIGNIFICANT EXPERIENCE WITH ASTERISK, ITS SETUP AND USE. VOIPJET IS A RESELLER OF TELECOM SERVICES, ONLY. IT PURCHASES THE SERVICES IT SELLS FROM OTHER INTERMEDIARY COMPANIES, ONLY. VOIPJET DOES NOT CURRENTLY DEAL DIRECTLY WITH THE PUBLIC, MAJOR INTERNET PROVIDERS, MAJOR TELECOMMUNICATION COMPANIES BOTH SERVICE AND HARDWARE, NOR CREDIT CARD, BANKING OR FINANCIAL COMPANIES. LET IT BE CLEARLY UNDERSTOOD THAT VOIPJET RECEIVES IP DATA PACKETS AND DELIVERS IP DATA PACKETS AND ITSELF DOES NOT OWN TELECOM EQUIPMENT. THEREFORE, VOIPJET'S BUSINESS IS IP-TO-IP VOIP DATA COMMUNICATIONS, ONLY AND EXCLUSIVELY WITHOUT EXCEPTION.

Information on VoipJet's site regarding service, including but not limited to termination providers, is based information passed to it from intermediary companies and have not been verified. THE DECISION TO PURCHASE SERVICES FROM VOIPJET SHOULD BE BASED ON THE LIMITED FREE TRIAL AND NOTHING ELSE. FURTHERMORE, IT IS THE CUSTOMERS RESPONSIBILITY TO ONLY DRAW CONCLUSIONS FROM THE FREE TESTING THAT ARE APPROPRIATE, THAT ONLY APPLY TO THE NUMBERS CALLED, AT THE TIMES THEY WERE CALLED, ON THE DAYS THEY WERE CALLED. NO IMPLICATION MAY BE MADE ABOUT OTHER CALLS, OR CALLS TO THE TESTED NUMBERS ON DAYS OTHER THAN ON THE TESTING DATE. AGAIN, THIS IS AN EXPERIMENTAL AND HIGHLY UNRELIABLE SERVICE.

VOIPJET DOES NOT SUGGEST, AND VEHEMENTLY DENIES, ANY CLAIM THAT ITS VOIP SERVICES HAVE A LEVEL OF QUALITY OR RELIABILITY ANYWHERE NEAR THAT OF THE REGULAR PHONE SYSTEM

The customer agrees to safeguard their username, password and connection string information. The customer is responsibile for all usage on their account. Users with dynamic IPs understand the additional risk they face, and will not keep large amounts of money in their accounts at any given time. Customers with static IPs will inform VoipJet of their static IP address immediately and without fail.

The customer will inform VoipJet of any payment or billing disputes with three (3) business days of their occurence. Suspected breach of username/password/dial string will be communicated to VoipJet within one (1) hour of the suspicion.

This contract and professional relationship shall be governed by the laws of Canada, in the province of Ontario. The customer agrees to submit to this exclusive jurisdiction of the courts of the above, only.

VOIPJET DOES NOT ENCRYPT ITS VOIP TRANSMISSIONS, NOR SENSITIVE PARTS OF CUSTOMER INFORMATION IN ITS DATABASES. VOIPJET RETAINS THE RIGHT TO VOLUNTARILY HAND OVER INFORMATION REGARDING CUSTOMERS, USAGE AND CALLS TO GOVERNMENTAL ORGANIZATIONS THAT REQUEST IT.

VOIPJET DOES NOT STORE CREDIT NUMBERS OR ADDRESSES ASSOCIATED WITH THEM.

VOIPJET WILL NOT SELL YOUR PERSONAL OR CORPORATE INFORMATION TO THIRD PARTIES.
